These Terms govern your use of Qweko, a digital menu and order-management service for restaurants. Qweko is operated, hosted and maintained by Kontextt, a software company established and lawfully operating in Algeria. By creating an account or using the service, you agree to these Terms. If you are accepting on behalf of a business, you confirm that you are authorised to bind that business.
1. The service
Qweko lets a restaurant publish a menu that its guests open on their own phones, and lets the restaurant receive and manage the resulting orders. The service is provided over the internet and is accessed through a web browser; no installation is required.
We may add, change or remove features over time. We will not make a change that removes a material part of what you are paying for without telling you in advance. Features available to you depend on the plan you subscribe to.
The service is provided on an "as available" basis. We work to keep it running and accessible, but we do not guarantee uninterrupted or error-free operation, and we may suspend access temporarily for maintenance, updates or security reasons.
2. Your account
You register by submitting your restaurant's details. Registration alone does not activate the service: each account is reviewed by us and becomes usable only once we approve and activate it. We may decline a registration without giving reasons.
You are responsible for everything done through your account. In particular you must:
- give accurate registration details and keep them up to date;
- keep your password confidential and not share your login with anyone;
- make sure any staff account you create is used only by the person it was created for;
- tell us promptly if you believe your account has been accessed without your permission.
You may create accounts for members of your team. You remain responsible for their use of the service and for what they do with the data it contains.
3. Your content and your data
Your menu, prices, photographs, restaurant details and order records remain yours. You grant us only the permission we need to host, process and display that content in order to operate the service for you.
You are responsible for the content you publish. You confirm that you have the right to use it, that it is accurate, and that it does not infringe anyone else's rights. Prices, descriptions, allergen information and anything else you show to your guests are yours to keep correct.
The commercial relationship for any order is between you and your guest. Qweko is not a party to it, does not sell food, and does not take a commission on any order.
4. Payments between you and your guests
Qweko does not process, hold, transfer or handle payments between you and your guests. Guests pay you directly, by whatever means you accept. Any amount shown in the service is a record for your convenience, not a payment instrument.
Because no money for an order passes through us, we cannot be responsible for a payment that a guest fails to make, disputes, or makes incorrectly, nor for any delivery fee you choose to charge.
5. Subscriptions and pricing
Access to the service is sold as a subscription for a fixed term, chosen when you subscribe. Prices are shown in Algerian dinars and are set by us.
We may change our prices at any time. A price change never affects a term you have already paid for: it applies from your next renewal, and the price you were shown when you paid is the price you pay for that term.
Subscriptions do not renew automatically and we hold no payment instrument on file. Continuing beyond your current term requires a new payment from you.
We may grant a free trial period of up to sixty (60) days, usually when we activate a new account. Trials are granted at our discretion, may be varied or shortened, and give no right to continued free access once they end.
6. Paying for your subscription
Payment is made outside the platform, by the methods we accept from time to time, and is then submitted to us for verification together with proof of payment. Your subscription is extended once we have verified that proof, not when you submit it. Verification normally takes between 24 and 72 hours.
We may refuse any proof of payment we consider unclear, incomplete, altered or suspicious. Where we believe proof has been falsified, we may suspend or terminate the account immediately and without notice.
All payments are collected in the name of Kontextt or of its owner. A payment made to any other name is not a payment to us and does not extend your subscription.
7. Renewal, grace period and expiry
Shortly before your subscription ends we will notify you that the term is closing and open a window in which you can submit payment for the next term.
If your subscription ends without a verified payment, a grace period of three (3) days follows, during which the service keeps working. Any time used within the grace period is counted as part of the term you go on to pay for, not added on top of it.
If the grace period passes without a verified payment, access is suspended: your dashboard becomes unavailable and your menu stops being reachable by your guests. Your data is retained and access is restored when payment is verified.
8. Changing plan
You may upgrade to a higher plan at any time. When you upgrade, you pay the difference between what you have already paid for the unused part of your current term and the price of the new one; the upgrade takes effect once that payment is verified.
You may move to a lower plan for your next term. A downgrade takes effect at the start of the next term and never mid-term, and we do not refund or credit the difference. Features that belong to the higher plan stop working when the downgrade takes effect.
9. Refunds
Subscriptions are sold for a fixed term and are not refundable. We do not refund unused time, whether it is unused because you stopped using the service, changed plan, closed your account, or had access suspended for breach of these Terms.
We will correct a payment that was genuinely made in error — for example a duplicate payment for the same term, or a payment of the wrong amount — where you tell us promptly and the error can be verified. That correction is normally made as credit against your subscription.
10. Acceptable use
You must use the service lawfully and honestly. You must not:
- publish anything unlawful, misleading, offensive, or that you have no right to publish;
- use the service to sell anything you are not lawfully permitted to sell;
- attempt to gain access to any account, data or part of the system that is not yours;
- attempt to disrupt, overload, probe or interfere with the service or its security;
- copy, resell, sublicense or make the service available to a third party as if it were your own;
- submit false or altered proof of payment.
We may investigate suspected misuse and take any action we consider appropriate, including suspending access.
11. Suspension and termination
We may suspend or terminate an account where we consider it necessary — including for breach of these Terms, suspected fraud, non-payment, a legal requirement, or conduct that puts the service or other users at risk. Where circumstances allow, we will tell you why.
You may stop using the service at any time. To close your account and have your data removed, contact us and we will act on your request; see our Privacy Policy for how that is handled.
Termination does not entitle you to a refund of any unused part of your term, and does not affect any amount already due.
12. Liability
Nothing in these Terms excludes liability that cannot lawfully be excluded. Subject to that, we are not liable for lost profits, lost revenue, lost custom, or any indirect or consequential loss arising from your use of the service.
Our total liability to you in any twelve-month period is limited to the amount you paid us for the service in that period.
You remain responsible for running your own business: for the accuracy of your menu and prices, for fulfilling the orders you accept, for your relationship with your guests, and for meeting the legal obligations that apply to your restaurant.
13. Changes, governing law and contact
We may update these Terms. Where a change is material we will give notice through the service or by email, and continuing to use Qweko after a change takes effect means you accept the updated Terms. The date at the top of this page shows when it was last revised.
These Terms are governed by Algerian law, and the courts of Algeria have jurisdiction over any dispute arising from them. If any provision is found unenforceable, the rest remains in force.
